Akamai Wins Permanent Injunction Against Digital Island
In December 2001, a jury found that Digital Island's Footprint service infringed multiple claims of U.S. Patent No. 6,108,703, issued in the name of Akamai founders Tom Leighton and the late Danny Lewin. Judge Rya Zobel will establish the final wording of the injunction to be granted against Digital Island's Footprint service. A trial to determine damages to be paid by Digital Island is expected to take place next year.
In a key companion ruling, the Court also denied Digital Island's post-trial motion that the patent was unenforceable.
"We are extremely pleased with the Court's ruling, which vindicates our patent rights and the value of Akamai's industry-leading technology," said Paul Sagan, president of Akamai. "We believe Digital Island cannot effectively operate its content delivery service without violating these key claims of the patent."
