CAMBRIDGE, Mass. - July 16, 2002 - Akamai Technologies, Inc. (NASDAQ: AKAM) today confirmed that the company is the target of a new patent infringement suit filed by Cable & Wireless, PLC in federal court in Boston, but Akamai maintains the matter is irrelevant to the company's operations.
"We are aware of the details of a new patent issued to Cable & Wireless, and it is just another version of the same so-called 'fingerprinting' technology that a jury previously determined Akamai does not infringe," said Paul Sagan, president of Akamai. "We are confident that Akamai does not infringe the new patent. Given the timing of this new suit, it appears that Cable & Wireless decided to act simply to divert attention from the permanent injunction that is expected to be issued against them this summer, by the federal district court, as a result of a jury finding that Cable & Wireless' Footprint content delivery service infringes Akamai patent rights."
Last December, a jury in federal district court found that the Footprint content delivery service, now operated under the Exodus brand as part of Cable and Wireless, and previously operated by Digital Island, infringes Akamai patent rights. The same jury found that the Akamai FreeFlowSM content delivery service does not infringe patent rights, now held by Cable and Wireless, that cover only limited ways in which content may be stored and served over a computer network such as the Internet.
